Pre-Conference Workshop: Amending an OSV charterparty to meet the requirements of the MLC 2006

This half-day workshop was designed to bring you up to speed with how the standard OSV charterparty may need to be amended to address the effects of the MLC 2006. There are many clauses impacted by the ratification of MLC 2006, failure to understand the potential risks and ramifications of these is not to be taken lightly. This half-day workshop ensured awareness of the risks and suitable corrective actions to be taken as necessary.  

Who Should Attend:

This workshop was designed for Chartering Managers, Contracts Managers, Contracts Administrators and Commercial Managers from Owners and Charterers as well as Maritime Lawyers who look after this area for their clients. 

AMENDING AN OSV CHARTERPARTY TO MEET THE REQUIREMENTS OF THE MLC 2006

OBJECTIVE - To look at a standard OSV charterparty with a view to considering and drafting amendments and additional clauses that may be needed to address the effect of the MLC 2006.
 
The workshop was broken down into four sessions, each of which contained a 15 minute breakout and a 5 minute review focusing on specific elements, selected by the attendees. An outline of the workshop timetable is as follows:

14:00 – 14:45 Session one
The first session will be a general discussion about the potential overall impact to the charterparty in order to implement the effect of the MLC 2006. The first session will identify some of the specific charterparty clauses that are, or may be, affected.
14:25 - 14:45: breakout and review (15 minutes followed by 5 minute review)
 
14:45 – 15:30 Session two
Having identified a list of clauses that may be impacted by the MLC, key clauses will be selected and the impact of the MLC on these clauses discussed in more detail. The second session will then endeavour to draft additional wording and/or amendments required to these clauses.
15:10 - 15:30: breakout and review (15 minutes followed by 5 minute review)
 
15:30 – 16:00 Coffee Break
 
16:00 – 16:45 Session three
Further key clauses will be selected and the impact of the MLC on these clauses discussed in more detail. The third session will then endeavour to draft additional wording and/or amendments required to these clauses.
16:25 - 16:45: breakout and review (15 minutes followed by 5 minute review)
 
16:45 – 17:30 Session four
The final session will consider what additional/supplementary clauses are required as a result of the MLC impact on the charterparty. The final working group will then endeavour to draft wording wording for these additional clauses.
17:10 - 17:30: breakout and review (15 minutes followed by 5 minute review)
